In the midst of the high-profile ambulance procurement case, Deputy Attorney General Alfred Tuah-Yeboah has expressed skepticism regarding the impact of an audio recording recently admitted into evidence. The recording allegedly involves conversations between the Attorney General and Richard Jakpa, a key figure in the trial.
Tuah-Yeboah asserted that the audio, despite its admission, lacks conclusive evidence that would sway the outcome in favor of Richard Jakpa, who is the third accused person in the case. "The fact that the audio has been admitted does not guarantee a favorable outcome for Jakpa," he remarked during a recent interview.
The admission of the audio recording was authorized by Justice Afia Serwah Asare-Botwe, the presiding judge, during a hearing on June 13, 2024. The decision followed a mistrial application where the judge cited reasons of fairness in allowing electronic evidence presented by the prosecution.
Responding to concerns about the potential impact of the audio, Tuah-Yeboah remained steadfast. "Not at all because this audio is something that you have heard, isn’t it? Haven’t you heard it, you have heard it," he retorted when questioned by JoyNews. "So what is unique in it? It's about the procedure so in terms of the content we are not minded by that because it is something that is in the public domain."
He emphasized that the admission of such evidence is a procedural matter rather than a judgment on its persuasive strength. "We are just saying that that is due process, it can be tendered and we are going by it," he added, underscoring the legal basis for admitting electronic recordings in court proceedings.
